By accessing or using AIVE ONE Beta, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. These terms apply to all users, including free-tier and paid subscribers. We reserve the right to modify these terms with prior notice as described in Section 9 of our Privacy Policy.
You must provide a valid email address to create an account. Email verification is required before full access is granted. Each individual is limited to one personal account. You are responsible for maintaining the confidentiality of your account credentials. Enterprise accounts may have multiple seats managed by a designated administrator.
Paid plans are billed in Indian Rupees (INR). All displayed prices include 18% GST. Subscriptions auto-renew at the end of each billing cycle unless cancelled. You may cancel at any time, and your access will continue until the end of the current billing period. We offer a 30-day refund policy from the date of initial purchase for annual plans. Monthly plans are non-refundable after the billing period begins.
You agree to use AIVE ONE Beta only for lawful purposes and in accordance with this policy. The following activities are expressly prohibited:
Violations of this policy may result in immediate account suspension or termination, without refund, and may be reported to relevant law enforcement authorities.
Your Content: You retain full ownership of all content you create, import, or export using AIVE ONE Beta. We claim no rights over your projects, media, rendered outputs, or any derivative works you produce. By using cloud render or cloud-assisted features, you grant AIVE a limited, temporary licence to process your content solely to deliver the requested service. This licence terminates upon delivery or deletion of the processed content.
AIVE Property: The AIVE ONE Beta software, including its proprietary source code, user interface design, documentation, APIs, algorithms, and associated trade secrets, is the exclusive intellectual property of AIVE ONE LLP and is protected under the Indian Copyright Act, 1957, the Indian Trade Marks Act, 1999, and applicable international intellectual property treaties.
Third-Party Components: AIVE ONE Beta incorporates third-party AI components, including natural language processing services provided by Anthropic, Inc. AIVE makes no claim to ownership of these third-party AI models or their underlying weights; such components are subject to their respective providers' terms of service. Open-source software components are used under their respective licenses, listed on our Licenses page.
Trademarks: The AIVE ONE Beta name, logo, visual identity, and branding are registered trademarks of AIVE ONE LLP and may not be used without prior written permission. See our Trademark Attribution page for third-party notices.
Feedback: If you provide feedback, suggestions, or feature requests to AIVE, you grant AIVE a non-exclusive, royalty-free, perpetual, worldwide licence to use and incorporate such feedback into the product without obligation to you.
AIVE ONE Beta includes AI-powered features such as automated editing suggestions, pacing analysis, and content-aware tools. These features are assistive in nature and are provided as recommendations only. You are solely responsible for reviewing and approving all AI-generated suggestions before they are applied to your project. AIVE does not guarantee the accuracy, suitability, or quality of AI-generated outputs.
Voice & Biometric Restriction: AIVE ONE Beta's transcription and voice-analysis features must not be used to collect, store, derive, or sell biometric identifiers or voiceprints of any individual who has not provided explicit, informed written consent. You may not use these features to build voice profiles of third parties, including without limitation for surveillance, identity verification, or targeted advertising. Users subject to the Illinois Biometric Information Privacy Act (BIPA) or analogous laws must comply with all applicable notice and consent requirements before processing any biometric data through AIVE ONE Beta.
Export and cloud render capabilities are subject to quotas defined by your subscription plan. Free-tier users receive limited cloud render minutes per month. Paid plans include higher or unlimited quotas as specified on the pricing page. A fair use policy applies to all plans to prevent abuse. Excessive usage that impacts service quality for other users may result in temporary throttling. Rendered files are available for download for 7 days after completion.
AIVE ONE Beta provides the following service level commitments for cloud-based features:
Exclusions: The following are excluded from SLA calculations: scheduled maintenance windows (communicated at least 24 hours in advance via email and in-app notification), force majeure events, third-party service outages (Razorpay, Anthropic API, etc.), and issues caused by your own network or equipment.
Service Credits: In the event of an SLA breach, affected paid users are eligible for pro-rata service credits upon request. Credits are calculated as a percentage of the monthly subscription fee proportional to the downtime exceeding the SLA threshold. Service credits must be claimed within 30 days of the incident and are applied as account credit toward future billing cycles. Credits shall not exceed 30% of the monthly subscription fee for any single incident.
Support Response Times: Free-tier users receive community support. Pro plan subscribers receive email support with a 24-hour response time (business days, IST). Enterprise subscribers receive priority support with a 4-hour response time and a designated account manager.
To the maximum extent permitted by law, AIVE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, but is not limited to, loss of data, loss of profits, or business interruption. Our total liability for any claim arising from these terms shall not exceed the amount you paid to AIVE in the twelve months preceding the claim.
You may cancel your account at any time from your account settings. Upon cancellation, your data will be retained for 30 days to allow for reactivation or data export. After 30 days, all personal data and project files will be permanently deleted. We reserve the right to suspend or terminate accounts that violate these terms, with notice except in cases of severe abuse or legal obligation.
These Terms of Service shall be governed by, and construed in accordance with, the laws of the Republic of India, including but not limited to the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Indian Contract Act, 1872, and the Consumer Protection Act, 2019, without regard to any conflict-of-law principles.
Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these terms, or the breach, termination, or invalidity thereof, shall first be submitted to mediation administered by a mutually agreed mediator in New Delhi, India. If mediation fails to resolve the dispute within 60 days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts located in New Delhi, Delhi, India.
Severability: If any provision of these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
Waiver: No failure or delay by AIVE in exercising any right under these terms shall constitute a waiver of that right. A waiver of any provision on one occasion shall not be construed as a waiver of that provision on any subsequent occasion.
EU / EEA / UK Consumer Rights: If you are a consumer habitually resident in the European Economic Area, the United Kingdom, or another jurisdiction that grants mandatory consumer protections that cannot be excluded or limited by contract (including rights under the EU Consumer Rights Directive 2011/83/EU or the UK Consumer Rights Act 2015), nothing in these terms affects those statutory rights. Such consumers retain the right to bring proceedings before the courts of their country of habitual residence, and the exclusive jurisdiction clause above does not override that right.
